TERMS AND CONDITIONS

1. Who we are

Phuket Venture Co., Ltd. ("Phuket Venture", "we"), 55/897 Phuket Villa-Dowroong Soi 3/6, Moo 2, Chao-Fa Road, T. Vichit, A. Muang, Phuket 83000, Thailand. Licensed by the Tourism Authority of Thailand, licence no. 34/00323.

2. Scope

These terms apply to all bookings of excursions, transfers and other travel services that Phuket Venture confirms in writing, whether you book directly or through an agency. Each quotation or booking confirmation may add conditions for a specific service; if it does, the conditions in the confirmation prevail.

Accommodation, events and MICE programmes may carry additional conditions from the hotel or venue, which we will send you with the quotation.

3. Enquiries and bookings

An enquiry through this website, by email or by WhatsApp is not a booking. A booking is confirmed only when we confirm it in writing and receive the payment required in section 5.

When you receive your invoice, please check it and tell us straight away about any error or change. If we do not hear from you, we will take the invoice as correct.

4. Prices

• Prices are in Thai baht (THB) and include VAT unless stated otherwise.
• Quoted prices may change before confirmation if fuel prices in Thailand rise significantly (in particular above THB 35 per litre).
• National park fees are not included unless the quotation says so, and are paid on the spot.
• Pick-ups from some areas carry a supplement or are available by private transfer only. The quotation states it.
• Prices for shared (join-in) services are based on a minimum charge of two adults. Some programmes need a minimum number of participants, stated in the quotation.

5. Payment

• Individual bookings: payment in full when we confirm the booking.
• Group bookings: a deposit of 50% at least 30 days before the service date confirms the booking. The remaining 50% is due 14 days before the group's arrival. Your quotation tells you whether your booking is a group booking.
• We will send you the payment details with your invoice.
• Bank charges and transfer fees are paid by the client and cannot be deducted from the amount due.

6. Cancellations and no-shows by the client

Cancellations must be sent to us in writing. These charges apply to individual and group bookings.

Excursions and activities

Shared transfers

• Cancellations must reach us at least 6 hours before the scheduled arrival or departure. Delays or cancellations without notice are charged in full as a no-show.
• If you ask us to wait for a later arrival, it is charged as a new booking.

Private coach transfers

• Cancellations must reach us at least 3 days before arrival or departure. Otherwise 100% is charged.

Waiting time at Phuket airport

• Shared transfers wait up to 1 hour. Private coaches wait up to 2 hours. Beyond that, the service is charged as a no-show, and if you still need the vehicle to wait, the normal rate is charged again.

Where a refund is due, we will make it to the account you paid from.

7. Changes and cancellations by Phuket Venture

Programmes may change without notice because of the weather or sea conditions. Some boat trips run only from November to April, or when the weather allows. Diving trip dates and sites are flexible and are confirmed before booking.

If we have to cancel a service, or the weather or sea conditions do not allow it to run, you can choose another date, a suitable alternative, or a refund for the service not provided. Some providers have their own rules, which we will tell you in the quotation (for example, golf courses issue rain-check vouchers instead of refunds).

8. Events beyond our control

We are not liable for changes, delays or cancellations caused by events beyond our reasonable control, such as severe weather or sea conditions, natural disasters, epidemics, strikes, closures of national parks or attractions, or decisions of governments or authorities. In those cases we will offer you the options in section 7, but we cannot pay any other costs or compensation.

9. Guides

Our tours and transfers are guided in English. Guides in other languages are available on request, at a supplement.

10. Children

Children aged 3 to 11 pay a child rate. On private tours, the child rate is 80% of the adult rate.

11. Your responsibilities

• Some activities have their own requirements (for example age, height, weight, health or dress code). We will tell you in the quotation; please tell us before booking if anyone in your party may not meet them.
• Equipment lost or damaged during an activity is charged at the provider's replacement cost.
• You are responsible for having a valid passport and any visa you need, and for meeting Thailand's entry and health requirements.

12. Liability

We arrange the services we confirm with reasonable care. Hotels, boats, restaurants, venues and activities are run by independent providers under their own conditions. We are not liable for:

• your own acts or omissions, or those of anyone in your party;
• flight delays or cancellations;
• loss of or damage to personal belongings;
• events beyond our control (section 8).

Where we are liable, our liability is limited to the price of the service concerned, except where the law does not allow this limit, for example for death or personal injury caused by our negligence.

13. Personal data

We handle your personal data as described in our Privacy Policy.

14. Use of this website

The content of this website, including text and photographs, belongs to Phuket Venture or is used with permission. Information on the website is for guidance; the details that apply to your booking are those in your written confirmation.

15. Governing law

These terms are governed by the laws of Thailand, and the courts of Thailand have jurisdiction over any dispute.

16. Changes to these terms

We may update these terms. The version that applies to your booking is the one in force on the date we confirm it.
